Legal Counsel

General Statement of Duties:
This position is designated by the Sheriff as the Assistant Legal Counsel to the Essex County Sheriff's Department.
As a senior member of the Sheriff's Command Staff, he/she is responsible for all matters pertaining to legal matters.
Responsible for providing leadership, guidance, direction, counsel and control necessary for the administration of the Sheriff's Department within accepted professional standards and applicable law.
Supervision Received:
Performs duties under the general supervision of the General Counsel.
Supervision Exercised:
Under the direction of the General Counsel, provide counsel and supervision over managers, department heads and supervisors responsible for the administration and operation of the Department.
Supervises designated clerical staff and assigns duties as required for the normal operations of the Sheriff's Department.
Essential Functions:
Provides legal counsel to the Sheriff and staff regarding management, Fiscal, Human Resources, Internal Affairs on correctional and operational issues.
Participate in and advise Command Staff.
Provide legal advice to the Superintendent/Middleton, Superintendent/ECPRC, Fiscal, Human Resources, Procurement, Internal Affairs, Civil Process, and Records Access Officer regarding Correctional and operational issues.
Provide legal counsel for personnel, labor, disciplinary, termination, and grievance and arbitration matters.
Assist with collective bargaining for the (3) unions in the negotiating and drafting of Collective Bargaining Agreements.
Represent the Department and serve as a Liaison with outside Defense Counsel in the litigation of employee, inmate, and other civil litigation.
Respond to public records and other information requests.
Liaise with local, state, and federal agencies, and Massachusetts Sheriff's Association.
Provide training of academy, correctional, supervisory, and managerial employees.
Negotiate and draft contracts and memorandum of agreements.

This is a full-time position.

Qualifications:
Required Education and
Experience:
Juris Doctor (JD) degree, admission to the Massachusetts Bar and extensive experience in legal research, legal writing, and legal procedures and processes.
Excellent Communication skills (both oral and written), and organizational and management skills necessary.
Ability to assist in the planning and directing of activities and operations of a correctional institution.
Considerable knowledge of the principles and methods of correctional institution administration.
Ability to deal effectively with the public, government officials and legislative bodies.
In light of the duties and responsibilities of this position and work environment, prior experience in labor relations and employment law, while not a prerequisite to apply, will be given strong consideration and preference.
This would include among other things, prior experience in dealing with public sector labor unions, the handling of personnel matters and benefits-related issues, including disciplinary matters, providing guidance with respect to Internal Affairs investigations, handling grievances and arbitrations, and negotiating and drafting collective bargaining agreements.
Prior experience and familiarity with respect to the processing and handling of public records requests, including the pertinent statutory exemptions with respect thereto, will also be given strong consideration and preference.

The check can be for multiple reasons such as signing bonus, supplies, etc. The victim will be instructed to deposit the check and use the money for any of these reasons and then instructed to send the remaining funds to the fraudster. The check will bounce and the victim is left responsible.
